Worker Adjustment and Retraining Notification Act — requires 60 days notice before mass layoffs or plant closings.
The Worker Adjustment and Retraining Notification (WARN) Act is a federal law that requires employers with 100 or more employees to provide at least 60 days' advance written notice before a plant closing or mass layoff.
A plant closing is the shutdown of a single employment site that results in employment loss for 50 or more employees during any 30-day period. A mass layoff is a reduction in force that results in employment loss for 500 or more employees, or 50–499 employees if they constitute at least 33% of the workforce.
Notice must be provided to affected employees (or their union representatives), the state dislocated worker unit, and the chief elected official of the local government. Failure to provide proper WARN Act notice can result in liability for back pay and benefits for up to 60 days.
