At-Will Employment
An employment relationship where either party can terminate at any time without cause (with some exceptions).
At-will employment is the default employment relationship in the United States (except Montana), meaning either the employer or employee can terminate the employment relationship at any time, for any reason, or for no reason at all — as long as the reason is not illegal.
Illegal reasons for termination include discrimination based on protected characteristics (race, sex, religion, national origin, age, disability), retaliation for protected activities (filing a workers' comp claim, reporting workplace safety violations, participating in a union), or violation of an employment contract.
Employers should document performance issues and disciplinary actions carefully, even in at-will states, to protect against wrongful termination claims. An employee handbook with a clear at-will statement is an important risk management tool.
