ERISA

Employee Retirement Income Security Act — federal law governing employer-sponsored benefit plans.

The Employee Retirement Income Security Act (ERISA) is a federal law that sets minimum standards for most voluntarily established retirement and health plans in private industry to provide protection for individuals in these plans.

ERISA requires plans to provide participants with plan information including important facts about plan features and funding; sets minimum standards for participation, vesting, benefit accrual, and funding; requires accountability of plan fiduciaries; and gives participants the right to sue for benefits and breaches of fiduciary duty.

ERISA applies to most private-sector employee benefit plans, including 401(k) plans, pension plans, health insurance plans, disability insurance, and life insurance. Government plans and church plans are generally exempt from ERISA.
